Terms and Conditions
These Terms and Conditions ("Terms") govern your use of the website and services of Neko Insurance Services LLC, a Delaware limited liability company ("Neko," "we," "us"). By using our website or services, you agree to these Terms. If you use our services on behalf of a business, you confirm you are authorized to bind that business. A signed agreement with Neko takes priority over these Terms where they conflict.
1. Our services
Neko provides software, AI-enabled automation, and operations support to independent insurance agencies and the businesses they serve, including document processing, workflow automation, and back-office support.
2. Not insurance advice
Neko does not sell, solicit or negotiate insurance, does not issue policies or bonds, and is not an insurer. Information we provide is for operational and informational purposes and is not insurance, legal, tax or financial advice. Coverage decisions remain with you, your licensed insurance professionals, and the insurers.
3. Your responsibilities
- Provide accurate information and keep account credentials secure
- Have the rights and consents needed for any data you give us, including customer data
- Review outputs and approve consequential actions before they are taken on your behalf
- Use the services lawfully and not to send spam, infringe rights, or interfere with our systems
4. Your data
You keep ownership of the data you provide. You grant Neko a limited right to use it only to deliver and support the services. We handle personal information as described in our Privacy Policy and keep your business information confidential.
5. Our intellectual property
Neko owns its software, workflows, templates and other materials, and any improvements to them. Except as agreed in writing, you may not copy, resell or reverse engineer them.
6. Fees
Fees, payment terms and service scope are set out in your proposal or agreement with Neko. Late amounts may result in suspension of services.
7. Communications
Calls with Neko may be recorded and transcribed for quality and training, and we will tell you when they are. If you opt in to text messages, message and data rates may apply; reply STOP to opt out or HELP for help.
8. Disclaimers
The services are provided "as is" and "as available." To the fullest extent permitted by law, Neko disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. AI-generated outputs may contain errors and must be reviewed before use.
9. Limitation of liability
To the fullest extent permitted by law, Neko will not be liable for indirect, incidental, special, consequential or punitive damages, or lost profits, revenue or data. Neko's total liability for any claim relating to the services will not exceed the fees you paid Neko in the twelve months before the claim.
10. Indemnity
You agree to defend and indemnify Neko against third-party claims arising from your data, your use of the services in violation of these Terms, or your violation of law.
11. Termination
Either party may stop using or providing the services as set out in your agreement. Sections that by their nature should survive termination (including data, intellectual property, disclaimers, limitation of liability and indemnity) will survive.
12. Governing law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Miami-Dade County, Florida.
13. Changes
We may update these Terms. We will post the new version here and change the effective date above. Continued use after changes means you accept them.
